1. Acceptance of Terms

By creating an account, accessing, or using the ProxyTunnel.app website and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you are prohibited from using the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

ProxyTunnel provides access to a network of residential proxy IP addresses. You understand that the Service acts as a conduit for your internet traffic. We do not control the content accessed through our network, and you are solely responsible for the data transmitted.

3. Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions, Bandwidth, and Billing

4.1 Plans: We offer monthly subscription plans (Basic, Standard, Premium) that provide a specific allotment of bandwidth traffic (e.g., 5GB, 10GB, 20GB).

4.2 Recurring Billing: The Service is billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis. By starting a subscription, you authorize us to charge your payment method for the recurring subscription fee.

4.3 Rollover Policy: Unused bandwidth on active subscriptions rolls over to the next month, up to a maximum cap of 2x your monthly plan limit. If a subscription is cancelled or expires, all rolled-over bandwidth is forfeited.

4.4 Overage and Pausing: If you consume your allocated bandwidth before the end of your billing cycle, the Service will pause until the subscription renews or you upgrade your plan.

5. Payment Terms

5.1 Payment Processor: We use Stripe, Inc. ("Stripe") as our third-party payment processor. By using our Service, you agree to be bound by Stripe’s Services Agreement. We do not store your full credit card information on our servers.

5.2 Authorization: You represent and warrant that you have the legal right to use any credit card(s) or other payment method(s) utilized in connection with any Transaction.

6. Cancellation and Refunds

6.1 Cancellation: You may cancel your subscription renewal at any time via your account dashboard. You will continue to have access to the Service through the end of your current billing period.

6.2 Refund Policy: We offer a strict 3-day money-back guarantee for first-time orders only, provided that you have used less than 100MB of bandwidth. Please refer to our full Refund Policy for detailed eligibility criteria.

7. Acceptable Use and Restrictions

You agree to use the Service in compliance with all applicable laws and regulations. You specifically agree not to use the Service for any illegal activities, including but not limited to fraud, hacking, distribution of malware, or accessing illegal content. A violation of our Acceptable Use Policy will result in immediate account termination without refund.

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of ProxyTunnel.app and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. ProxyTunnel.app makes no representations or warranties of any kind, express or implied, regarding the operation of their services, or the information, content, or materials included therein. You expressly agree that your use of these services is at your sole risk.

10. Limitation of Liability

To the maximum extent permitted by law, ProxyTunnel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

11. Indemnification

You agree to defend, indemnify, and hold harmless ProxyTunnel.app and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
